I refer to our previous discussions and emails. On Thursday 24 May 2007 I=20
met with David Latina Executive Director and Craig Roberts Manager Small=20
Business Policy, both from the Office of Small Business. We discussed the=20
various difficulties aising from the application of the Retail Leases Act=20
to LG community leases, the existing determination made under section 5 of =

the Act dated 20 August 2004 & the difficulties arising from its=20
provisions and canvassed some options.
=20
The most significant of the possible options was the proposal that leases=20
of land not rateable under s154 of the LGA or rated under the Cultural and =

Recreation Lands Act 1963 be exempt from the RLA. The Office of Small=20
Business will instruct Dr Clyde Croft SC to provide advice on any=20
practical ramifications or unintended consequences that may arise from=20
this proposal.  The OSB will have the advice by no later than mid June=20
after which they will be in a better position to formulate options for=20
consultation=20

OSB is in the process of investigating the option and no policy decision=20
has yet been made. There is a clear commitment to consult with local=20
government on the way forward.=20

I'd welcome any preliminary comments you may have relating to the=20
proposal.
